Hello 

I am a US  Citizen from India and had filed for 1-130 for my parents green card. 

Since my birth certificate was issued late I got an RFE for both my parents applications for secondary evidence which includes: Medical records, Early school records, Insurance records, Employment records, Financial records or Government records.

Since I was born in India most of the records from school and other places mention my Father's name so I have secondary evidence needed for him.

Please know what I can do for my mother's application. I have their issued marriage certificate that proves their relationship since my birth.

Can I use the same documents, that I will use for my father along with marriage certificate or do I need to go the affidavit route.

  • A notarized affidavit executed by either a parent, if living, or another close relative older than the applicant.  This affidavit should clearly state the relationship between the deponent and the applicant, how well the deponent knows the applicant, the date and place of the applicant's birth, the names of both parents, and any other related facts. If the applicant has no living relatives that witnessed their birth, a self-attested affidavit detailing their knowledge of the facts of their birth may be accepted.”

 

I would get affidavits from both parents as well as close relatives, who were in the vicinity of your mother at the time you were born, especially any one who witnessed your  actual birth. 
 

Don’t be surprised if DNA evidence is later required. The embassy will specify an acceptable clinic.
