Timeline

:angry: For months following our marriage the things did not work out, I have filed for divorce.

According to the affidavit of support, I am responsible for the financial support if the spouse does not have a good job.

I want to know, if the US Citizen is responsible for their health benefits for the alien divorced spouse and the dependents, for many years to come, if she or he gets the permanent green card and does not have health insurance.

Any information is appreciated

Timeline

You are responsible to repay to the government any means-tested benifits drawn from the government by the alien until one of the following 5 conditions have been satisfied.

  • The benificiary works 40 quarters, about 10 years. (if they choose not to work then it can be indefinite)
  • The benificiary leaves the US and gives up residency
  • The benificiary Naturalizes and becomes a US Citizen
  • The benificiary dies
  • Or You the sponsor dies.

It wont be required by the 864, but may be required by the state court hearing the divorce action. Typically if she has it now, the court will want it to continue, especially if there are kids involved. It will continue for any length of time that you agree to if you settle out of court; whatever you negoiate in your final divorce settlement. If the court decides, they may continue it for some period of time, probably equal to the length of the marriage until she is able to get on her feet again. Ask your lawyer what is typical in your state.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

There's one more - the beneficiary becomes subject to removal and, in the removal procedings, is given a new grant of adjustment based on a new affidavit of support, if required.

Read the I-864 - it states what the sponsor's obligations are.
