Hi,

My wife went for the interview on Oct 5 IR1 and I also applied for her daughter I130 and her case is currently pending at NVC. In wife's appointment letter daughter's name was listed as Additional Applicant so she took daughter to the interview with her passport. (completed Medical and biometric as well)

Interview went ok and in the end the CO asked wife the passport and removed tourist visa and also asked daughter's passport and removed her tourist visa too and returned the passports back and said approving your case won't help since you have to wait for your

daughters case to reach here so once her case is approved we will approve your case and gave 221G and the letter says

"Bring the following documents to the VAC:
 -- evidence of approved petition for your child"

he said you can drop off copy of the approved petition at one of the drop off locations.

 

my question is what is the approved petition for the child means? is it I130 or NVC Documentarily Qualified?

That would be the I797 approval from USCIS.

Thanks for the update. Since I had not seen many post interview dates (for IR visa) in Sep and Oct (this month), I wasn't sure if the Consulate in Mumbai is giving appointments for IR visas. Then some people told me that they are not giving new appointments, but giving only to those whose got cancelled. 

I presume yours was not a cancelled case. 

On your question, it is my logical deduction that the consulate is asking for your daughter's I-130 approval. The reason I deduce that because from what I understand, in consular processing there are only two steps: 1. Approved I-130 2. Completing the NVC documents 
What is really odd is that the required NVC documents (for your wife's case) were not specific to your case. I mean if your daughter's I-130 approval was a pre-req prior to issuing her IR1 visa, then it should have been one of the documents requested by the NVC

Well, I am not a lawyer, so I don't know the nuances of the visa issuance process. But from what you are describing, the light is at the end of the tunnel. It might be some wait time, but there are no signs for any show stoppers.

Thanks for the response. At the end of the interview consular said I could give you the visa but you are still going to wait for daughter's case so in that case once her case is approved send her approved petition through VAC and we will approve it.

 

According to my wife there were lot of people at the interview mostly seniors.

 

Also when do they open 221g appointments?

I am sailing in the same boat. Need your advice.

I have been called for Interview(IR1 at Mumbai Embassy) on 01-Dec-2021 along with my daughter and her I-130 is still in Progress. 

So can I Re-schedule the interview till her I-130 gets completed?

Or If I attend the interview and if the Visa gets refused, Do we need to attend the interview again along with Medical check-up and Biometric?

I am very much confused. Please pour your thoughts.

You can attend and get your medical and biometric and the consular will ask if you are travelling alone or with daughter, if daughter's case is pending then he will give you 221g saying submit daughter's approved petition or they will approve your case and you have get your daughter's case expedited.

In the mean time, contact USCIS and say your interview is scheduled and can I get my daughter's case expedited and also get your local congressman to ask for it. Call NVC and ask them too. I did all 3 and it helped.
