Hi All,

Helping prepare an AOS package for parents of a USC, who overstayed a visitor visa (B2). A few questions: 

 

1- in the forms that asks for beneficiary's (parent) past and current employment, is entering Self-Employed acceptable? What address should they enter if jobs are in many different places, like contracts. home address? 

 

2- we hear often that undocumented immigrants should still file taxes (beneficiary filed). However none of the forms seem to ask for evidence/records that they did. Is that right? and should that tax filings be brought to AOS interview, or submitted with the package? does it need an explanation?

 

3- Beneficiary(parent) received an SSN from a student visa long ago (70s), does proof or evidence of it need to be submitted? They entered it in the forms, but don't have the original card and cannot get replacement

 

4- If petitioner meets I-864 requirements well above the guidelines, is it still recommended to add income from the other member of the household via I-864A or would it be overkill or fishy? (petitioner's spouse) adding them brings them to ~400% over guidelines..

1. Out whatever is correct, if self employed, self employed. Address would be whatever address he used for self employment, could be the home address.

 

2. No explanation required.

 

3. No proof required. Provide the number on the forms. Check SSN application on AOS/EAD form so he will get the ss card.

 

4. No need to add household member but If they file tax return jointly, good idea to include spouse and have him/her fill out  i864a.
