Somebody else that follows waiver stuff closely will have to tell you how that works. I don’t pay that much attention to it.

Great point @Wuozopo, those tax returns still show they were married. People file separately all the time for various reasons. 

 

 

I-751 Joint Filing.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

They require tax returns for the entire marriage up to and including the present date. So that means 18, 19, and 20. Doesnt matter if you are filing joint or with a waiver or if you filed taxes as MFJ/MFS, head of household, single, etc. You have to show you filed taxes since getting your card/date of marriage up to the present date.

 

You need to file your ROC prior to the card expiration. You can file sooner then the 90 day window if you are using a waiver. You are not divorced yet right? Do you have an ETA on how long the divorce will take? If you file the waiver ROC and do not include the divorce decree you will get an RFE and will need to send the divorce decree. So if you dont have the decree presently and are not expecting to get it quickly you are probably better off waiting until the 90 day window to file.
