Hello.

Firstly, id appreciate advice from people without making assumption and trying to make my life harder.

I am very confused.

Me and my wife had aos interview in 2016. Went ok but had some different answers when we were separated. My wife has tattoo on her chest and i used different word that has same meaning when i was asked what it says. Words are not very clearly seen on tattoo.

After that had house visit. And approval.

Filled RoC in august 2018. We had decent amount of evidence. Im gonna try to keep post short and its honestly hard for me to remember everything, but id say at least what average filler has, according to my lawyer he said more than enough at the time.

Dec 2019 i get RFE. We sent all new evidence, lease, taxes trips, photos, health insurance, car insurance, and bunch more "weaker" evidences.

May 2020 interview canceled - covid

Sept 2020 interview, very simple questions shoet interview. IO tells us she cant make decision to wait 120 days. When we asked why. She said u didnt travel anywhere in first year of marriage.

Ok so it seems my case has some red flags due to aos interview. Officer was a nightmare. 

 

Its been 180 days since interview. No response. Contacted congressman, ombudsman so far no help.. congressman did say they made inquiry for my case. 

 

Now me and my wife had some difficulties recently. We still love each other but we went thru some hard stuff, she made mistakes so did i. We are not sure what to do with marriage regardless of immigration. But immigration also makes us feel we are stuck in rabbit hole. My wife would always be there for me even if we separate. Now that can change idk. 

I know its a stupid question but does anyone know what we can do in order to strengthen my case but also not to make life decisioms based on immigration. I dont wanna get my case denied neither my wife does. But we also dont feel like our decision has to depend on uscis. It drives me nuts. I am sorry if i sound confusing. I am very confused personally 😕 but what r probabilities of things working out for me since my case already seems to be red flagged.

This is a really tough situation and I'm sorry you're going through this. With the immigration stuff, I'm not sure there are any other options you can take now besides to wait for their decision since you already contacted the congressman and the ombudsman. If the congressman said they made an inquiry, then hopefully, they will get back to you at some point. When exactly did you contact them? Mine took a couple months to get back to me.

 

As for your marriage, the only thing I can suggest is martial counseling. But that would mean you and your wife both must be willing to go to a counselor together and mutually agree to at least attempt to work on your marriage.

Hi. Thats for your response. I did get back from congressman that they did inqury about my case 22 days ago. And also told me to follow up if uscis doesnt respond.

But im also worried since ive seen people make inquiries and nothing happens. 

How long after congressman responded to you did u get an update from uscis?

We're in the same boat bro. It's worse for me since I got my 2nd interview just 1 month after the 1st one. It's been 90 days without decision. I and my wife are having big conflicts and we're hard stuck in the marriage. Both me and my wife don't want to mess up the case but if this keeps going, we're going to loose our minds. My N-400 estimate completion time is May 2021so I will wait until may to decide if we should do anything else.

I don't know if this helps, but I know a couple who had red flags, got grilled during their AOS interview (immediate stokes interview), and got approved 10 months later. This was pre-covid.

 

At this point the ball is in USCIS's court. Wait until USCIS makes a move and go from there. Try your best to not stress about it until at that time - I know it's easier said than done. You may be pleasantly surprised that your case was approved and then you and your wife can work on the relationship independent of immigration matters.
