Okay.. I decided to send out I-129F without I-797 NOA1 (I-130)..that still have not rcvd due to backlog or frontlog (whatever the prob is) at USCIS/CSC, computer glitches..etc..etc.. I called USCIS and asked rep if I could include as evidence: copies of cashed & stamped (uscis receipt #)check, usps deliver conf.card, online case status letter. Representative told me this would show as evidence that I-130 was filed, received and have receipt #. Now.. I already had a cover letter prepared (made by agency working with us in Jordan and signed by me) that says I've included (along with fees and other necessary docs).. my I-797 (for I-130 form). Should I re-do this letter or just add a memo explaining that I-797 was stated to be sent out (refer: online case status letter) but never received due to USCIS backlog and receipt system problems. But i have include the following documents (listed earlier). Im not sure exactly what to write and do.. Hope to get some feedback, advice, info.

thanks,

Gwen

p.s... i will send email to lawyer/agency regarding my intents and any changes regarding I-129F

Maybe i missed the question, but why don't you just write another cover letter and indicate exactly what you are including. This is what i did. I know you have a lawyer but you do not need him to change the cover letter since you are signing it. Just make sure they are ok with your plan.

good luck

I would suggest rewriting the letter with a phrase stating that due to delays at CSC in sending receipt notices I have included additional proof in place on the I-797. Omit the I-797 from your list of documents and add what documents you are sending.

Naturalization

3/23/14 - N400 package sent to Phoenix

3/27/14 - N400 package delivered

4/3/14 - NOA1 receipt date

4/4/14 - check cashed

04/29/14 - biometrics date

07/01/14 - interview date

xx/xx/xx - Oath Ceremony

Thanks to all...and mostly Thanks to God!! Alhumdulilah!!!

If I seemed a lil bit confused or unclear..well its just cuz I've been working long hard hours...then in the late evening/ early morning visiting VJ and working on what to do regarding getting I-129F out. After research, praying, research, praying..calling USCIS and waiting waiting waiting.. Brain and heart said.. GO FOR IT!... then as I reviewed I-129F contents.. I read cover letter (that Jordananian agency prepared for me). We were a lot more lost in Jordan..and we felt better having Arabic/English speaking assistance in Jordan for my husband. But I sure wish I discovered this site prior to going to Jordan. Anyway... my cover letter needed updating and I wasn't sure what exactly to write..(remember..I was overtired).. Well, this is how I updated it to be "what i thought" would be appropriate. I really was looking for sample letter so I could get an idea of how it should be (I wasn't going to copy word for word..and wouldn't recommend that for anyone)

Dear Sir/Madam:

I am enclosing my I-129F petition for my husband XXXXXXXX with the necessary fees. I have been informed that California Service Center (uscis.gov press release 062607) are experiencing system problems, which are causing delays in printouts of receipts. I have not yet received NOA1 (I-797) from USCIS-CSC. As evidence that I-130 petition has been filed and received by USCIS, I have included my (online) USCIS case status receipt notice for the I-130 Form, USPS Delivery confirmation notice and print out of cashed cashiers check with case receipt number (WACXXXXXX). I appreciate your time ................................

Enclosures:

  • COPY OF USCIS (ONLINE) RECEIPT NOTICE FOR I-130 PETITION
  • COPY OF USPS DELIVERY CONFIRMATION NOTICE
  • COPY OF POSTED CASHIERS CHECK FOR FILING FEE OF I-130

(LIST CONTINUES)

 sooooo... there it is. Not sure if it was too much or ??? but pray all goes well..and its goes thru and things move along faster. I really pray the waiting for NOA1 was not a sign of how delayed the rest will be ...(i mean slower than the norm..or whats shown in statistic/or other vj members whos travelled this prior to any of us May/June filers).

I sure miss my husband.. oh God you know how much :innocent: Praying for us all..and the system and journey we have to go thru.

Gwen

Keep trusting God and be encouraged. You will begin to see a light at the end of the tunnel soon.

Irene & Tawfiq

Alhumdulilah!!!!!!! Ok.. its done.. I mailed out my I-129F this morn and updated my timeline.. that felt great!!! Trying not to worry... I really really don't want to do ANYTHING that would cause more delays.. CSC is bringing enough delays without me. Thank You VJers for all your posts (questions, announcements.. updates, etc) Its helping me so much. Gosh!!! I wish we didnt go thru an agency. Spent extra money and I'm the one updating them with things that they didnt hear about(increase in fees, direct filing, updated version of I-129F). Whats up with dat? Oh well.. lets hope they really will help my husband in preparing and being successful with the rest of the steps in Jordan. Inshallah!!! Thank you for the encouragement and reminder to continue to trust God.
