Hi everyone,

 

My husband and I have our interview tomorrow to adjust his status from K1 to green card holder. We filed in Sept 2019 so did not have to submit the I-944 public charge form. I’ve seen some couples get RFEs for this form at their interview even though they filed I-485 prior to the rule requiring I-944. Does anyone have government documentation showing when this rule originally took effect? I can’t find it online and would like to print it from a government website and bring it as proof it is NOT required for us.

wow so you got your interview scheduled even though you filed in september and did not submit the i-944? lucky you!!!

I also filed during the time that the i-944 was blocked, but they were very quickly to send me a letter requesting the form as soon as the decision got stayed.

 

so here is what happened: the rule will be applied to anyone who filed after the end of february 2020, even if you filed during the SCOTUS decision that blocked it temporarily.

i would not advise you to claim the rule is not required for you, because that's not USCIS' instance on the matter. i would advise you to get all the documents and the form i-944 ready in case they demand it on the interview, though.

 

edit: maybe i'm too late now, and you prolly got your interview done. please come back to update us on how it went! :) hope all worked out!

edit2: damn i just realised you mentioned september 2019 not 2020! hahahah please nevermind my verbal diarrhea
