Hi Good evening,

 

I have some question about the process of petitioning from Tourist to AOS. My husband petition me last september for AOS. and weeks ago I also did my biometrics and picture taken after it was being reschedule due to government holiday. 2 days after I did my biometrics I got another mail from the USCIS of Request for Initial Evidence which it says that "the petitioning sponsor on Form I-864; Affidavit of Support" must submit a complete Federal income tax return. We have a sponsor for me for my husbands income is not enough to petition me and for a 3 household which is the minimum requirement. 

 

Now my concern and question is a day after we got that letter we sent a mail back to the USCIS with the document they were asking which we gave the copy of the complete Federal income tax return of our/my sponsor which is my Aunt but someone we know told us that it was mistake for we should have sent MY HUSBAND'S & AUNT'S federal income tax return. I just want to ask if did i do the right thing or not and what should I do after. It also says on the letter that we must submit all of the requested evidence at one time and if we only send part of the evidence the will based on what we sent back and that they will not consider any evidence that is submitted after the due date. I have 87 days to mail back.

Have you sent a 864 from your husband?

 

The USC spouse is always the main sponsor so all the required documents they ask in the instructions still apply to them. 

 

So when you add a joint sponsor, you now have to send 2 sets of 864, one from your husband and one from your joint sponsor, with all the required evidence.

Yes, we have sent a 864 of my husband and our joint sponsor. we all even attached those documents when we filed all the papers together at the beginning. 

 

Can I just send my husband's tax return or should I wait until USCIS send me another on the mail?
