So I live in brazil and my GF lives in texas..

we fell in love but i had to move back to brazil 20 days ago.

and now we want to get married and live in us

the thing is that shes about to turn 17 and im 18.

so is she able to apply the k1?

her mom approves we getting married and gives her permission to do it.

Hi,

Yes you guys could do a k-1, read the guides here, the biggest concern is what are you guys going to do in regards to meeting the financial requirements, she is prolly going to need a co-sponsor, unless she has a job where she makes 125% of the poverty limit, not hard to do. Read the guides they have all the forms you will need and read them carefully.

Yes, your girlfriend can file an I-129F petition for you. The hurdle you'll have to overcome is sponsorship. If she's not 17 yet, I doubt she's working full time.

Doesn't this young lady need to either have parental permission to file? Or does Texas allow marriages for people under 18? To file the I-129F she would either have to be 18 or have parental permission in writing (and notarised I would think) to submit with the application.

Is her mom willing to be financially responsible for you and everyone else in her household? The 2007 Poverty Guidelines will give you the exact amount needed for joint sponsorship per household members.

Ok, so let me see if I have this straight. The spouse must sign an I-864, a binding contract with the US Government, even though they have a joint sponsor. That makes sense. So, one must be 18 to execute a such a legal contract.

So, if she's barely 17 when they file the papers, he's going to need to wait until she's at least 17yrs 9mos to use the visa to enter the US in order to file AOS before the 90 days is up. Even though it is not critical to do so, it isn't good to wait very long after the 90 days.

Personally, I think you should have to be 18 to file the petition but I evidently not.

True, don't forget the K1 takes a few months.
