So me and the wife have been slowly putting together documentation. First of all I have some questions about the I-130 application

 

1) 12a-12e on I130. They want an address where the beneficiary intends to live. We currently live together in Ukraine. The plan is for me to get a job once she gets the visa and move back to the United States. I have nothing to put there since I have no idea where we will be living.

I am using my sisters address as my mailing address to receive my mail. I could put that there, but that wouldn't necessarily be true.

 

2) I have 2 addresses associated with me in Ukraine. One address is the apartment that we live in. We are not officially residing there. We are just renting from a private individual (a common practice in Ukraine). I do have an "official address" which is how the Ukraine government see's me. It is an apartment that my wife owns in another town. We live in Kyiv the capital. The apartment is like 60km away from us. I receive my mail at the Kyiv address (the apartment we rent and actually live in).

 

When they ask for your current address and your current mailing address. I really have 3 options

A) My mailing address in the United States where I don't actually live

B) The Kyiv address that we are unofficially renting.

C) The Fastiv address that I am officially residing in which belongs to my wife.

 

Which address is the most appropriate to give them on the I130. I really don't want to get rejected because of some stupid technicality like I gave them the wrong addy.

 

3) There is an end date for how long we lived together. But we don't have an end date because we currently live together. I can't just put PRESENT there, they demand a date.

 

So what date do I put there? Can I just write in "PRESENT" since the application will not take that?

The second part of my question is regarding the timing of our petition. We have finally got everything I wanted translated and notarized. Things like Marriage Certificate which we need. But also some documents that prove cohabitation and that we bought an expensive car together.

 

I could likely get the whole packet done in 6 days or so. Maybe by next Monday.

 

But there is a catch. We have a baby due any day now. She might even be born within the next 6 days. 

Would it make more sense to just wait for the babies birth? Since it gives us a pretty good evidence of bonafide relationship. I feel that when we go to the interview we will have ample evidence. But our initial package is so-so. We have lots of photos, but we don't really have anything else concrete. Our finances are together but all accounts are in either in US and in my name or in her name. Even the car was bought in her name and I just have a notarized power of attorney over it. 

 

It would likely delay us a bit. Maybe up to a month if we wait for a baby. Cause it's unlikely I'll have time to run around putting a package together while the baby is a newborn.


On the flip side I have read that good evidence heavy front loaded applications pass through faster. Does that make sense or should I just go ahead and send the application now?

Just the fact you live together will be all the evidence of bona fide relationship you need.  

 

With regard to the I-130 (A petition for alien relative, not an application for anything) read carefully, interpret literally, and answer accurately, the actual question being asked.  You can enter separate mailing address and physical address.  Your physical address is where you actually live.  There is no question about "official address".

So I used a friends address for my mailing cause my family is always moving and I just was scared my mail would get lost during the progress. And for current address I used where I lived. They send all the information to the mailing address. I remember hearing that they want the address that’s on your ID (so that’s current address). As for your baby, after I gave birth to my son I sent the birth certificate couple months after applying for my husband. I hope this helps good luck.

There is no question on any form about which address is on your ID.  They want a mailing address and the physical address where you live, PLUS 5 years of physical address history.  It really IS that SIMPLE.

"I was told", and "I heard" are notoriously unreliable sources.  Stick to real sources of information, like form instructions, and literal interpretation of form questions.
