hello folks.

i have question for ya guys i dont know if you can help me to figure out !

i am already in usa on k-3 visa and i been here for 2 years and still dint get approved on my i-130 yet my question is if i got approved on my i-130 and i got my 10 years green card . can i file after that for my citizenship or have to wait 3 years after i receive my green card from that date? i mean the 2 years i am here can be count with the time ?

My N-400 timeline, I hope it will help - Local Office (Chula Vista Field Office - San Diego)

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

The clock starts ticking when you get your greencard. The 2 years will help you since will not get a conditional green card as you would have been married from more than 2 yrs at the time of adjustment of status.

09/13/07: Received NOA1 (PD 5/31, RD 5/31, ND 9/10, PM 9/11)
11/15/07: Case Approved
11/20/07: Received NOA2 by mail (PD 5/31, RD 6/9, ND 11/15, PM 11/19)

You can not apply to become a citizen until 3 years after you are approved for a greencard.... so you will need to apply for AOS and once that is approved you can apply for citizenship 2 years and 9 months after the approval date that will be on your greencard.... your time as a K3 does not count....

Have to have a green card for 3 years to to file for citizenship.

One thing is when you do adjust status, it will result in 10 year card, not a conditional one.

I would schedule an info pass and ask about the I-130, it should have been approved some time ago.

What are you waiting for? You are about to become illegally present in the USA, if you aren't already.

Or applly to extend your status if you're wanting to get your LPR status via an immigrant visa.

Either way, as others have already told you, you don't start counting the 3 years to citizensip application until you become a LPR.

Sounds like OP is still waiting for NOA2 for the I-130, I believe a copy of that NOA is needed to be attached to I-485 when adjusting status based on an approved immigrant visa petition (I-130 for the CR-1/IR-1)

Perhaps the NOA2 for I-130 was lost, check the I-130 case number form NOA1 on line, to see if it was approved, and if so you may have to contact USCIS for another I-130 NOA2, or you may have to file I-824 to order another one.

Hi guys and thanx for ur reply

listen to me i went to immigration office and i spoke with immigration officer and she said .. ur papers went some where in mistake and we are so sorry for this 3 years waste. and she said u dont need to file for an extension and she give me a day to go there becuase she send a message to California Office to transffer my whole case to her office and she said some times we give approved in this office just for special cases like this becuase the sent my papsers like archive where they put the approved cases ... lol this is funny isnt? lol anyways i have appointment after 6 days and i will see what she will tell me ..

do u believe i waiting 3 years to get approved and my case in the archive?????????????

thats why i ask for my citzenship if i can applyu for it .. they should to let me do it because this is not my fault plus i have my SS# and work permit and all my papers that i need are donme except my i130 not approved yet to file for my i485 and i am worried now to wait longer and i heard in 3th of july the fees gunna go up :((

The fees do go up on July 30th. The AOS is included in a package deal for $1010.
