Hi,

My husband and I have been married 8 years - with our two U.S/Aus citizen children.  The first visa approved (fiance visa)  i moved from Australia to the U.S whilst he was in the navy.  We spent 3 years in the U.S and then decided to live in Australia.  We have been here for approx 3 years.  I abandoned (I 407) my conditional green card after we left the states.

 

I am looking to file I 130 as we would like to return.

 

From what I can gather by searching domicile is my husband needs to prove we have the means and want to go back to recommence a permanent life in the U.S.  Do I just file the I 130 form or are there others that I need to file at the same time? 

 

Has anyone else been through a similar experience and could give me some advise or tags to search 🙂

All starts with the I130.  Visa application and affidavit of support comes after petition approval

File the I -130.  When it gets to the NVC they may ask about his intention to re-establish domicile.   You have plenty of time to figure that out in the meantime.

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Sorry to piggyback this.

 

On the online i-130 form, it asks for "Where in the United States does the beneficiary intend to live?"

 

How would a couple who are both living abroad go about answering this if neither party has property in the USA?
