Applying for Citizenship and lifting conditions

Hello all

 

      I am sure this has been asked a million times but I get mixed answers from doing research.  My wife will have been a green card holder for 3 years as of January 2021.  We are still waiting for her I-751 to be approved.  She filed in February and has had her biometrics done already.  Is she able to start the citizenship process before she gets approval on her I-751?   Thanks all.

Where are you getting mixed answers? Pretty common knowledge that you can file N400 when your window opens even if your I751 is still pending.

Yes she can file while ROC is pending.

An application for naturalization may not be approved if there is a pending petition for removal of conditions. If an applicant’s petition to remove conditions is pending at the time of filing or is filed prior to the interview, USCIS will adjudicate the petition to remove conditions prior to or concurrently with the adjudication of the naturalization application

Have had a Permanent Resident (Green) Cardfor at least five years, or for at least three years if you’re filing as the spouse of a U.S. citizen

  • Your card will expire within six months of applying, or
  • Your card has already expired
