Hi all! First post here, so hopefully I’m doing this right.

I’m from Vegas and our economy / job availability is still kind of in shambles right now...I want to say we are treading around 30% unemployment and I am part of that 30%. I really want to file and start the K1 process, but considering I’m currently on government aid would that disqualify me based on the evidence of support? What kind of issues should I expect from that? Me and my fiancé have been apart for almost four years now and we want to close the gap. :(

K1 process:

  • 10-28-2020 - i-129f Received at Lockbox
  • 12-08-2020 - NOA1
  • 06-14-2021 - RFE
  • 07-06-2021 - NOA2
  • 08-19-2021 - Arrived at Embassy
  • 10-07-2021 - Checklist received
  • 10-21-2021 - Interview & Approval
  • 12-29-2021 - Marriage :)

AOS:

  • 01-29-2022 - Package sent to Phoenix Lockbox
  • 02-02-2022 - Credit Card Charged
  • 02-12-2022 - Notice of Biometrics
  • 03-09-2022 - Biometrics Appointment

It would not disqualify you but it doesn’t help you either. You can file the k1- you don’t need to show your income/complete the affidavit of support until the embassy stage so probably a year from now. If you still have $0 income at that point you will need a joint sponsor if the country allows it. Please update your profile with the country.

FYI-If unemployment benefits are the only benefits you are on- they are not considered government aid.

Also you say you have been apart from your fiancé for 4 years- is that the last time you saw her? If so then you don’t meet the basic requirements for k1. You have to have met within the last 2 years

Oh no, we have seen each other a lot and are currently together at the moment.  I more so meant we aren’t in the same country for four years now. But thanks for the answer! I’m from the US, so do I need to put that as my country of immigration? My fiancé is from Denmark.

Denmark would be the country 🙂 Have you thought about getting married and applying for cr1 instead? K1s and CR1s Both have their Benefits but if you guys are able to be together I’d suggest CR1.
