USC non-dependent stepchild

Hello,

I'm married to a USC. He has a prior marriage to another USC, and they had 2 children, who are also USC. The ex-wife has majority custody and my husband pays child support. I am trying to file for US citizenship.

For my case, under the 'your family' section, should I list these step children or not?

If I list them, then in the evidence section it asks for evidence for being the parent of the children (birth certificate, adoption papers or court order for becoming a parent). I don't have any of these as I am not the guardian of the children.

This seems to imply that I do not have stepchildren?

You have to list the stepchildren 

and your husband should have court papers (either thru the divorce or children services) saying who has custody including who can claim them on tax returns

You should list them. Based on my own experience, I didn't submit evidence for my stepchildren. Just for biological child. During my naturalization interview, the IO asked about my children. When l mentioned all of them, he only asked me questions about my biological child. My interview was approved.

yes we do have all of those papers, and we don't list them on our taxes as dependents (because their mom does)

Bring all those documents to your interview just in case the IO wants to see them. I was not asked for any document.
