Can a K2 receive a valid I-94 stamp when entering the US?

There's not much info on here about K2s, but I'd imagine they'll get an I-94 stamp that is good for ninety days or until their parent is married. In the case of a "follow-to-join" I'm not too sure how that would work. Seeing as my step-daughter-to-be is only six, it's not much of an issue, and you only get a $400 break if the K2 is under 14 when the new AOS fees go into effect.

If you mean the I-94 work authorization stamp the answer is NO as a K-2 is not employment authorized incident to status like a K-1 is.

What exactly do you mean by I-94 stamp? K-2s get an I-94 card valid for 90 days stapled in the passport if that is what you mean.

If you mean EAD stamp on the I-94, only K-1 would get that stamp, only the K-1 is work authorized for the 90 days of the I-94, K2, K3, or K4 are not work authorized.

I am having difficulty trying to get answers from my company's health insurance rep. I will have four K2 of which two will be 14 and older and will be required to pay the new AOS fee. So, we will be filing for their EAD when we file for AOS anyways. The other two K2 are 12 an younger, and I am not sure its possible to get a an EAD for them until they are older.

The health insurance rep. explained to me the two younger K2's which do not have SSN's can be enrolled in the health insurance but without having a SSN we cannot file a medical claim. (What good is that?).

So my next question is does the the 2 year green card serve as work authorization if the EAD was not filed?

I enrolled my wife (K-1) on to my health insurance policy as soon as we were married, she had no SSN at the time, and we were able to immediately claim a doctors visit.

You are not required to furnish a SSN to the medical insurance company.

Must I give my Social Security number to private businesses?

Usually, no, you do not have to provide your Social Security number. You are not legally required to provide your SSN to private businesses — including private health care providers and insurers — unless you are involved in a transaction in which the Internal Revenue Service requires notification. (MediCal and Medicare are government health plans and can require a Social Security number.)

I am going to agree with YuAndDan here... I think you uneed to push the health plan provider for an alternative... I am sure they have or will find a alternative to the SSN.... The person you may be talking to may not be aware and needs to do some research

I agree with fwaguy. The SSN has gone FAR beyond it's intended purpose. That is, your account number for Social Security. I mean, the gas company, phone company, etc. all want it, too, and if you say "no" they have no idea what to do. I'm sure there is some form of identification that would be allowable, probably their A-number on their visa.

The problem I'm having with my K2 is figuring out how to enroll her in school. The school officials I talked to said it shouldn't be a problem, just need her birth certificate, immunization record, and my gas bill or something that says I live in the district.
