Applying for Citizenship after ROC through waiver

Hello

 

Just got my 10 yrs gc with divorce waiver.

My 5 years anniversary will be next year in December.

 

I was wondering if there is a way to apply immediately?

I stayed married from sept 2015 to october 2017  before divorcing.

Congrats.

There is a difference between when you got married and when you first got your first green card. 

For the purpose of citizenship its based on when you first got your green card. E.g you got married in May 2015 but got your first green card june 2016, your citizenship timeline starts from June  2016

So i gotta wait 5 years from my issuing date?

Its dec 2016.

So 90 days prior dec 2021 i can apply,?

 

What i am trying to understand is

Since i was married and i got it like that is there any way to find a crack in the rules to where i can apply now ?

You can file starting 90 days prior to the 5 year anniversary of becoming a permanent resident. That date is the "Resident Since" on your green card (assuming it it correct - it should be when either you entered on an immigrant visa or when an I-485 was approved).

Correct.

No, there is no basis to file sooner based on the information provided.

There are other ways to obtain citizenship, although that would be via other means, like military service.

Oh ok so basically the roc through waiver wipes out the fact that i got my gc through marriage. Right?

Exactly what I thought. Gotta wait 12 more months :)

To file under the 3 year rule, you must also be married to a USC for the 3 years prior to filing the N-400 + remain married until you take oath.

 

The fact that you did ROC via a divorce waiver doesn't directly impact this...in theory you could have married a different USC and then wait the 3 years from the date of that marriage.

But barring that case of remarriage, you need to wait for the 5 year rule.
