I researched quite a bit about this, but I've got difference answers. I have a stepson, he is from the previous marriage of my wife. He lives with his father, me and my wife only see him a few days of the month, my wife pays child support, not me. Do I have to list him on the N-400? Even though he doesn't live with me and I don't pay for child support.

 

 

I also forgot mention, he is american, he was born in USA.

"Indicate your total number of children. Count all of your children, regardless of whether they are alive, missing, deceased; born in other countries or in the United States; under 18 years of age or over 18 years of age; married or unmarried; living with you or elsewhere; current stepchildren; legally adopted children; or children born when you were not married."

I understood that, but i don't have documents to show. The only thing that I have is child support coming out of my wife's paycheck. On the N-400 is asking for evidence. She doesn't have his birth certificate because it's with his father. The divorce ended badly, I don't even know how to ask her ex-husband for the birth certificate. Should I just write a document in word, attach on the evidences and  explain?

She’s on the birth certificate I would assume so she can go to the courthouse and pay $25 and receive a copy directly through them  without going though the ex husband. Some states will even allow you to order online
