How long can you wait to submit AOS after marriage?

Due to the coronavirus, I likely will not receive my certified marriage license from the clerk's office for two weeks (they are closed). Just got married for K1 within the 90 day window, but now the calendar date (April 30th) is past the original 90 days. I just have the initial marriage license from the clerk, filled out with the marriage details and date.

For the AOS, is a certified marriage license / certificate required, or can I mail a copy of what I currently have (the initial marriage license filled out with the marriage details and signed)?

Secondly, is there a timeframe for how long you can wait to mail the AOS after the marriage and subsequently after the original 90 day calendar window? As referenced above, my hold up is the certified marriage license / certificate.

Thank you all for your guidance and advice!

  • 3 weeks later...

I am in the same boat as you (same sex couple here tho) and there's really no timeline. As a matter of fact, you really don't want to wait that long, makes no sense. But anyways, I am in the same boat, we have all the documents ready in a bin but all I'm missing is our marriage certificate. The cook county clerk office here in Chicago has been closed for 3 months already and vitalchek doesn't have record of it just yet. So that's pretty much what's holding us back now. 'till the clerk office opens I guess 😭😭😭
