K-1 Visa Process and the CoVid-19

Timeline

I know everything will be backed up due to the Pandemic. But I am in a unique situation I think. I have already gotten my NOA2 notice and it has a date of mId August to finish the interview process for my K-1 Fiancee Visa. But she is here in the USA stuck right now and cannot fly back home on a valid B1/B2 Tourist Visa which is also good until Mid August. My concern is since Venezuela interviews are in Bogota now and she can't get to Venezuela (her home) or to Bogota (for interview), at what point do I start trying to get an extension on her B1/B2 Visa? and at what point do I get an extension of the K-1 date? Any advice appreciated.

I would start on the B1/B2 and do research for your answer. I don't think you'll be able to do anything till USCIS opens back up, but you can give them a call. They are still answering the phone.

 

The validity of the NOA2 is for four months. They want you to complete your visa processing at the consulate during that window. The reason is that they have thousands of approved applicants and they need to keep things moving along or they will back up if everyone decides they want to process in a particular month then the other months there are relatively few interviews. So, because we are in different times, the embassy will still need to give you the extension. Better to tackle that problem when we have a clearer picture when the embassies begin to open.

Are there any repatriation flights? Contact the nearest embassy or consulate...they should have information on efforts to get home.

 

The I-129F can be extended by the US consulate if necessary. I expect they will do so given the circumstances, but keep in touch with them as well.

 

Option 1) See above. You also have a good chunk of time to make any decision. I get that right now is a bad time to travel commercially, but this will likely change with options becoming available in the coming weeks and months.

Option 2) File an extension of status (I-539) to "ride out" until things improve.

Option 3) Marry in the US then do AOS now.
