K-1 I-129F Petition in Potomac no response

Hello, 

 

Me and my fiance filed for a K-1 petition in June 2019 and it landed in Potomac. Since then, it's been transferred to the National Benefits Center, back to Potomac, transferred to National Benefits Center again, and... back to Potomac. We never got any explanations for why it's been going back and forth like that, and we have only received transfer notices for the first two transfers, and they said it was due to load balancing. I've tried calling USCIS customer service and spoke to level 2 representatives numerous times, as well as spoke to a supervisor. No one could tell us what's happening. We have even tried reaching out to our State Senator's office and had them submit a service request. Unfortunately, all three of our service requests were responded to by saying "We cannot provide you a timeline for your case processing". I'm considering reaching out to our Senator's office and our US Representative's office again. It has been almost 10 months and I'm wondering if anyone has come across something similar, or had their I-129F processed in Potomac?

 

Not sure if this is important, but I've also changed my address and submitted all necessary paperwork to USCIS regarding my move.

So you submitted an I-129F for a K-1 to the Texas lockbox, which assigned it to Nebraska initially (what are the first 3 characters of the receipt number?), which was then transferred ~3 months later to Potomac. Then to NBC. Then back to Potomac.

 

If so, that is very highly unusual. All I-129Fs are sent to CSC initially, which certain types of cases sent to VSC. The other service centers don't normally even adjudicate them (they will I-129Fs for a K-3, though).

My receipt number starts with YSC. Also, we actually filed two petitions. One for my fiance, and another I-130 for my mother, who is also from Russia. Since the petitions were filed at the same time. I'm suspecting that's why they both ended up in Potomac...

The Chicago lockbox does not take in I-129Fs. All I-129Fs are sent to the Texas lockbox.

Were they both sent to the Chicago lockbox?

That might explain it...the I-129F should not have been sent there. What should have happened is they should have rejected the I-129F and sent it back so you could file it properly. But I guess some worker there made a mistake and accepted it, and my guess is it's going through all sorts of "not me" routing.

Since they were sent together, it's also quite possible they didn't even check it and thought it was an I-129F for a K-3 (these can be filed concurrently with an I-130) so that's why they accepted it. Once somebody actually looked it, it probably got sent elsewhere as they don't handle it. But if not sent to the right place (should be CSC), that loop will probably continue.

 

You can try reaching out to the CIS Ombudsman. Maybe they can get it sorted out with where it is supposed to go.
