CHANGE OF STATUS FROM B2 TO I130/I485

Good day!

 

I know its a tough time for everyone right now and I hope you and your family are staying safe.  I know all of you are busy right now and I would really appreciate if you will answer some of my questions as the application for change of status is really confusing. My name is Jacky and my husband is Pat

 

Backgroud: Ria - nurse in Middle East, has approved i140 petition (priority date Nov 2018)

                     Dexter - US citizen and works in the military and is currently assigned in Middle East

 

I came here as a visitor last February 5 solely to get married, take my exam and go back to Middle East with my husband supposedly on April 7. Unfortunately, 2 weeks after my arrival the movement for employment based petition i140 retrogressed and corona virus got worse. Now, my husband and I are trying to re assess our situation and trying to fill out the forms needed for family based petition and change of status.

 

1. Since most of  the lawyers in California are asking for 3,000 usd and more for this application, we opted to do it on our own as we can't afford to pay as much right now. I need some help in filling out form I-485.

** Part 2, Page 4, #12- It says there If you are the principal applicant, provide the following information. Receipt Number of Underlying Petition (if any)

12.  Priority Date from Underlying Petition (if any)  --- Do I need to mention my receipt number and priority date in my i140 (employment based petition) or just leave it blank.

 

2. Do you suggest hiring a lawyer with this kind of situation and application??

The i130 is the underlying petition to the i485.  If you are concurrently filing the i130 then that is left blank

September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
