K1 visa without a salary in U.S.

Hello all,

I am the petitioner for my fiance and our i-129f was approved in late January, now we are just waiting for packet 3 from consulate to arrive.

I am still currently employed in Hong Kong, but have made plans to move with fiance to the states once her K1 visa is approved.

I have not secured a U.S. job yet but has passed NCLEX 2 months ago and got an active RN license .

We have assets in our U.S. bank account more than 5x annual salary of 120% poverty line and I have Form 1040 tax return for 2016-2018 foreign income (Pending to file 2019).

What I am worried now is that my fiance will get denied in the coming interview, as I don't have a U.S.-based income or experience yet.

Do you guys think this is a concern?

Should we delay the process so that I can go first to find a job in the states?

You currently have income to support your fiance which is positive. Second, you have the capacity to earn once you return to the states. Where your income is earned is not such a concern to the embassy as much as it that you are making sufficient income to support your family for the future. Since you have filed your taxes with foreign earned income you shouldn't have a problem. Bring all your supporting financial documents to the interview. Good luck and I wouldn't worry.

If I read English correctly this is all that is needed... being qualified as a RN in the USA is a great bonus.

"We have assets in our U.S. bank account more than 5x annual salary of 120% poverty line"

Oops, I mean "our assets is more than 3 times of 125% of Federal Poverty Guidelines", since I have zero U.S. income for Affidavit of Support. Thanks for pointing it out!
