Sorry to be new to the board and just post all these questions, but I really just don't know where to turn.

I'm getting officially divorced to my American wife on this coming July 17th, 2007...at 11:00AM:) I cant wait:)

However, I'm scared to death that it might have some sort of negative impact on getting approved for my Thai fiance to get her K1 Visa. Will this have any bearing on approval? As far as financial support, I'm on active duty in the US Navy...so there will be no problem showing that I can provide for her financially...and I have absolutely NO criminal background.

Also, I'm only 23 years old (turning 24 on September 12). Will my young age work against me in this case? I'm hoping they dont view me as some young kid who doesn't know what he's doing, and then they dissaprove on those terms.

My USCIC is Nebraska...and it's showing that they are just processing cases from May of 2006. That's over a YEAR ago. So does this mean it takes them a YEAR to just process through my petition??? That seems like FOREVER.

I've also got an attorney who is doing all the paperwork for me here and in Bangkok for my girl. He's got a 100% approval rate, so I'm really hoping here. I'm trying to do all I can to get my girl over here.

What do you guys, the masters, think about my situation??

24 JUL 07 : K1 arrived in Lincoln, NE

24 JUL 07 : USPS status of package: DELIVERED:)

02 AUG 07 : NOA1 from CSC

03 DEC 07: NOA2

12 DEC 07: NVC Receives

14 DEC 07: NVC sends to Bangkok

17 DEC 07: Consulate receives

08 JAN 08: Packet 3 sent

08 JAN 08: Given date of interview

11 JAN 08: Interview...approved already before getting to the window!...NO questions asked

25 JAN 08: My lady arrives in IAD-Washington DC:)

19 APR 08: Married in Alexandria, VA (5 days before Visa expires)

20 JUN 08: Mailing in AOS packet

18 DEC 09: GREEN CARD RECEIVED:)

Dont worry about the divorce, we applied for my K-1 last year 2 weeks after my USC husband got divorced from his ex-wife.

Also the age doesnt really matter. All they want is both of you to be legally able to marry ( never married or legally divorced) and they will make sure that she has no criminal background and shes gonna have a medical examination.

As for your case you will have to send it to Nebraska but its gonna be forwarded to California because nebraska doesnt process K-1s anymore. I don't know about the average time lately but few months ago it was around 2-3 months to get an approval from CSC.

Also just to mention, the 2-3 months I just told you is only for your petition to be approved, its not the time it takes to have the actual Visa in hand. Your petition will have to be forwarded to NVC and then to the embassy in Thailand. And the final approval on the visa is given at the embassy at her interview. My process took around 8 months total before I got the Visa in hand ( in Canada).

My USCIC is Nebraska...and it's showing that they are just processing cases from May of 2006. That's over a YEAR ago. So does this mean it takes them a YEAR to just process through my petition??? That seems like FOREVER.

I would like to know where you read that Nebraska is processing I-129F's for K-1 dated May 2006 as they do not report I-129F processing dates and have not done so for quite some time.

Maybe so, but it is important for the OP to understand that a I-129 petition for Alien Worker and an I-129F petition for Alien Fiance(e) are two very differet animals. Improperly using terminology (particularly acronyms) will get one wrong answers.

Indeed... one of my bugbears (another one! I have so many! :whistle: ) is the tendency for people to talk about filing 'the 129' and 'the 325' - huh?!?! Attention to detail is just ever so slightly important with this stuff...

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Welcome to the board J. If your attorney is advertising a 100% approval rate I am betting he/she is referring to petition approval and not visa approval. I'd ask what they're basing those percentages on.

Having your attorney do all your paperwork and double check everything will not make the process go faster. As a large number of people on here have discovered, it has actually caused the process to go slower. You're better off doing your own research here on VJ and doing it yourself, because you're the only person who has the most interest in ensuring your fiancée receives her visa in a timely manner..... your attorney's interest is financial.

It's actually a 100% VISA approval rate:)

I would say usually the cases tend to take more time with an attorney because its an additional step, mail has to be sent to them and then they advice you if anything. When you file yourself you receive everything directly. I've also heard of some people missing their interview at the embassy because the attorney received the letter and he was on vacation for 2 weeks so they got the notice too late.....etc Hope you have a good one.

As for the 5-6 months, I would not hope too much on that. 4-5 months is sometimes the time it takes for the petition to be approved and sent to the embassy...and sometimes you have to wait a long time to get the actual interview date. I dont know about the embassy in Thailand but just for an example, Montreal ( canada) as a wait of 4 to 7 months before they give you an interview date.

We didn't use an attorney as you will find many on here didn't. It is your choice however, I'm certainly not going to tell you not to. We found it very simple to fill out the forms and do this ourselves and it saved us a ton of money...money we used to fly back and forth to see each other. As for an attorney making the process faster....Nope. It is always good to have a consultation with an immigration attorney, but I don't think I've read one single case where using an attorney made the process go faster. As for the reasonable time frame you list, tha'ts hard to say...each case is processed individually and all you can do is look at timelines from other couples going through the same embassy/consulate as you would probably go through. Having your attorney do all your paperwork and double check everything will not make the process go faster. As a large number of people on here have discovered, it has actually caused the process to go slower.
