I'm at my wit's end. My partner is currently here in the UK with me visiting for 6 months so obviously has no income therefore cannot provide proof of income. I was intending on living off my savings of several thousand pounds plus we have been promised support from both my parents here in UK and his parents back in NE until we marry and I get work permit. We also have offer of somewhere free to live as a friend of his family owns an appartment she doesn't use. Obviously he would get a job once he goes back. I know I would have enough to live off for at least 12months on purely savings as our only essential outgoings would be food. Is it worth me even trying for my K-1 or should I just accept the fact that it's a non starter. We are options and the desperation is getting unbearable.

11/13/2007 - NOA2...127days after filing (hard copy 11/17/07)

12/22/2007 - packet 3 rec. (12/28/2007 returned)

01/11/2008 - medical (allergic to tetanus shot, requirement waived)

02/05/2008 - interview @ 10am - APPROVED!!!!!!

03/12/2008 - Flying Glasgow - Dublin - Chicago - Omaha

07/31/2008 - AOS and EAD finally mailed

08/02/2008 - Delivered

08/08/2008 - Check cleared

08/11/2008 - NOA1's for AOS and EAD recieved (reciept date 08/07/2008)

08/16/2008 - Biometrics letter recieved

09/09/2008 - Biometrics at 1pm, Omaha

09/26/2008 - AOS transferred to CSC

09/29/2008 - AOS touched (took out envelope at CSC and put in new pile)

10/03/2008 - AOS touched (probably that RFE coming soon!!!!)

10/06/2008 - AOS touched AGAIN!!! (surely it's an RFE)

10/15/2008 - EAD CARD PRODUCTION ORDERED!!!!YEY!!!

Also, seeing as you're going through London, you might be able to self-sponsor. People have had success (I'm not sure how recently) in getting approved at the London consulate by showing evidence of their assets ('several thousand pounds' sounds like it could possibly be enough to convince them, but I'm really not sure of what they'd consider 'enough') instead of the US petitioner's income. I'm not sure, but I'm guessing your fiance would need to fill out an I-134 anyway...

Just an idea, because I have read of a few people having success that way - although you'll probably want to look into co-sponsorship anyway (his parents?), as when it comes to AOS, your bank balance will be of no interest to USCIS, you'll need a sponsor to fill in an I-864 for you. But for the 'first hurdle', you MIGHT be able to use your own funds to sponsor yourself... just bear in mind that that's only the first hurdle!! :)

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Your SO could go work to line a job up from over there, and go home prior to the interview and begin working.

Are you reading the responses? You don't need a lawyer to fill out a standard I-134 form. The co-sponsor can do it themselves without assistance.

Well I am new to this too ...but If I understand correctly if your assets add up to the amount that they are looking for ....couldn't you transfer the money to an account in her name and call it "her money"???...Or is that a silly answer ...I was actually wondering this myself ...

That should be a silly answer. One of the reasons that a statement from the bank, or a series of account statements, is requested to document a bank account is to spot unusual transactions such as you suggest. Money that appears out of nowhere is highly suspect.

A case officer may not look that closely at the documentation, but if they do and start asking questions about it the intended deciept could have painful consequences.

If his parents or other close family/friends are willing, just co-sponsor. Its the EXACT same form you have to fill out (I-134) for the embassy. I just filled this out today and it is the easiest form to do so far. Just co-sponsor and dont worry.
