What to do now that my husband has his K-3 visa....

Hi everyone! So I went to Peru 2 weeks ago to meet up with my husband for our interview and his K-3 was approved!!! Yea!!! Very exciting. And the interview wasn't as scary as we had anticipated although they did ask sveral questions about the 2 tourist visas he had applied for (and been denied). Now I have a few questions about what to do since my husband won't be able to come until August due to work and studies. We thought about doing the I-130 interview in Peru too but are worried that there might be too much of a delay since I am still gathering info for the I-864. So if we wait to adjust his status here in the US, these are my questions which might be kind of straight-forward but I would feel better if I have some answers from all of you experts!:

1. Can we go ahead and apply for the Employment Authorization (EAD) now or does he have to be in the country for that??

2. How long does the EAD usually take to get approved?

3. How long is the AOS process here in the US taking??

4. I paid the I-864 fee already-- does that count still if we do the AOS here instead of in Peru??

12/2/05 NOA2- I-129F approved!

03/14/06 K-3 interview in Lima (had to postpone from original date of 2/1/06)

03/14/06-- Interview-- K-3 approved!!!

Needs to be in the US

From a few months to a couple of years depending on which District Office you will go through. CheckHERE

4. I paid the I-864 fee already-- does that count still if we do the AOS here instead of in Peru??

To my knowledge, no.

Congrats on the visa and just remember it is only valid for 6 months.

EAD takes about 90 days. If after 90 days you haven't received it yet (which happens to be the case at the moment for most cases) you an get an interim EAD through an infopass appointment at your local office.

Good to know re: the EAD wait-time although I was surprised to see that at the San Antonio district office they are looking at EAD applications from Feb 15th already.... is this unusual? or is that date not all that telling-- ie does it still take a while to get the EAD approved?
