N-400 application with name change

I have submitted name change along with my N-400 application in 2017, passed interview on July 2018. I haven't received oath ceremony letter yet. I don't want to change name any more, what should I do?

So it's been over a year since you had your interview??  Please tell me you've called USCIS somewhere between then and now to inquire about your oath ceremony....

Yes, I have constantly reach out to USCIS inquired about my case. It is under pending adjudication for one year. I tried reaching out to US. senator, local congresswomen and CIS to have them help me. They received the same respond too.

Now I am wondering if I keep my name not change because I request name change in the N400 application.

Was the new name you requested something that would have raised any eyebrows?  There was another member on here who requested a new first, middle and last name change and the officer had a lot of questions during their interview about the significance of each name...and then pending background checks on the new names chosen after the interview...but didn't take quite as long as yours is (if that's the reason for the delay).

Ok that's a bit different than first saying you passed the interview and hadn't received the oath letter---it gave the impression upon reading that you've been inline for your oath ceremony all this time.

You have to submit in writing to the field office handling your case that you  no longer request a name change.

Make sure to include a copy of the N-652 letter you received after your N400 interview.

I didn't get the N-652 letter after my interview because there was a technical issue on the day of interview. The officer asked me to come back the next day to sign the documents. He did asked me if he said I passed the interview the day before and I remembered he said I passed. 

How do I submitted a written letter to the office since that branch no longer accept infopass and walk in?

By mail.  They do accept infopasses, you just have to call now and request it with the agent over the phone.  If they deem your reason satisfactory, an appointment for an infopass is granted.

So I just send them a copy of my green card, DL and written letter regarding not changing my name to they branch office, does it sound right?

I would suggest telling them something like "it's been pending a final decision for more than what is allowed by their own policy (120 days)."   Explain that you've already contacted senators, congresspeople, etc.   Be polite, but don't be afraid to get angry later on if you have to.  If the person still refuses your request---call back and request it with the next person who answers the phone.

DL not needed.

 

Since you don't have the N-652, I would also suggest including the receipt notice for the N400 when you filed, as well as a brief explanation that you've already had the interview on such-and-such date and was recommended for approval (and the officer's name if you remember it).

As an alternative---I would also suggest calling and asking to be transferred to a L2 officer who can look into your personal case details.  It's possible that an oath letter WAS sent out, and it was never delivered to you.

I called USCIS once a month since March 2018, and I always speak to L2 officer. They all said the same thing asking me to continue waiting and they can't do anything.

Have they said you are undergoing background checks, or just said to keep on waiting?  If it's background checks (due to the name change or other reasons after the interview) then there's not much you can do to speed that up.

 

Were there any red flags in your case or things that the officer mentioned he had to look into after your interview?

Two L2 officers did mention they are doing background checks, but most of them are just saying it is under pending adjudication.

The interview officer is very nice and mellow, so there is no red flag for him, everything went smooth except their technical issue.

Perhaps having a different congressperson contact them would be beneficial at this point----however if you're still in background checks, well...

 

The ultimate option would be to file a Writ of Mandamus which forces USCIS to make a final decision---however it can commonly backfire and end up in a forced denial due to any pending background checks not being completed.

I would like to remove my name change request prior now. 

I have consult with lawyer and it cost 8k just file a Writ of Mandamus.......

I've seen some lawyers charge double that or more for the WoM.  😕  It's not something that is generally done on the cheap side.
