Hi All,

I'm new in this forum.

I'm a US citizen and in the Form I-130 applying process for my wife from Bangladesh. She has a child from her ex husband. Does she need to obtain any written permission from her ex to bring her child to the US with her? What if her ex does not consent?  What's her option(s)? The child has been with her since birth.

Thanks in advance for your help in this matter.

Regards,

Yes

Then she can’t take the child. If she takes the child without any consent/permission whatsoever, it’s considered international kidnapping and/or human trafficking. The father has parental rights too. Imagine you in the shoes of the father, that you have a child with your ex, and all of the sudden, the ex wants to move with the child to Bangladesh. What would you think about that?

She has to convince the ex to consent to letting the child immigrate to the US and/or giving up his parental rights. Sometimes people use $$$ as an incentive. There is only one other way, that is going into court and somehow have the court take his parental rights from him. I have no idea how that works in Bangladesh, but here in the US, you pretty much has to convince the court that he is completely crazy, absolutely out of his mind
