Hello VJ!

 

I have found this site to be invaluable over the past couple of years so thank you to all for that!   I have a situation that I couldn't find a similar question for in the forums.  My wife was approved for her IR-1 last month so we have about 5 months to go before we need to enter the US.  Our situation is that we are currently in Hong Kong and plan on moving to the US in February, 2020.   That is well within the 6 month time range that we are allowed.  The thing is we want to go on vacation in Guam in December.  I read here in VJ that Guam is a legitimate PoE and they can activate/validate her IR-1 to make it official when she goes there.  The concern that I have is that we will then go back to Hong Kong to live for 2 months before permanently moving to the US.  Do you think there is an issue with activating an IR-1 visa and then immediately leaving the US for 2 months before returning?  Once we return, we will be in the US the rest of the year so she will be in the US around 10 months total in 2020.  I just don't want to raise any red flags when we enter the US and then return to Hong Kong for a couple of months before permanently moving to the US.   If there is a big concern, we will need to forego the Guam vacation. 

 

Any advice or wisdom VJ can share would be much appreciated!

First off, the visa is "activated" the moment it was issued by the embassy.    

 

Guam is a POE for the USA, so yes when she clears POE in GUAM she will receive an I-551 stamp in her passport (equivalent to a green card valid for 1 year).    That stamp will allow her to international travel and re-enter the USA during its validity period.    As long as your plan is to return the the USA in 2 months all is good.

 

No reason to forego your travels to Guam.    

 

Also, if you have paid the Immigration Fee to USCIS the green card will be ordered and then delivered to the address on record.
