I-751 Affidavit Signature Date

My wife and I are getting ready to have the required affidavits about our relationship prepared and signed.  My question is in regards to the signature date on these affidavits.  Since the petition cannot be submitted until the 90-day window, before her conditional permanent residency status expires, do the affidavits also need to be signed and notarized within that same 90-day window?  Or, for example, could they be notarized a few weeks prior to the window, say within 120 days of status expiration?

There is no requirement for the affidavits to be signed within the 90 days window for filing.  However, affidavits are not required, and many people think they are not worth the effort.. .We did not send any affidavits for my wife's ROC......good luck.....

Affidavits are generally thought of as sub-par examples of relationship evidence (there are certainly much better types of evidence), and most folks don't bother with them.  Anybody can write an affidavit. Though the affiants have to remember that they can be called in to testify as to the veracity of their affidavit. They are not required, they are but an other example of the type of relationship evidence mentioned by USCIS in the I-751 instructions. There is no mention of notarization, and no time frames noted.

5. Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. (Such persons may be required to testify before an immigration officer as to the information contained in the affidavit.) The original affidavit must be submitted and also contain the following information regarding the person making the affidavit: his or her full name and address; date and place of birth; relationship to you or your spouse, if any; and full information and complete details explaining how the person acquired his or her knowledge. Affidavits must be supported by other types of evidence listed above.
