If illegally do you mean they came here and were documented but overstayed, or just entered the country un-documented?

Also to become a Citizen you first need to be here legally for 5 years as an LPR with green-card.

He cant become a citizen (at least not yet), and the process to become an LPR wont be easy and only possible if he marries someone who is either an LPR or Citizen.
Note: if marries an LPR there is a 2-3 year wait for a visa number to even get approval on the I-130, a US citizen would get immediate approval of the I-130

My fiance has been in the US for a few years now and is here illegaly and we are trying to get everything so he is not here illegaly but i have no idea where to start or what to do. Can someone please help?

My fiance has been in the US for a few years now and is here illegaly and we are trying to get everything so he is not here illegaly but i have no idea where to start or what to do. Can someone please help?

You start by filing for a I-129F petition for a K1 Fiance visa. Once the petition is approved it will be sent to Ciudad Juarez where he will eventually go for his interview. At the interview he will be denied due to his illegal presence and he will be told if he is eligible to file a 601 waiver. You as the USC have to prove extreme hardship to you if his visa is ultimately denied. With the Ciudad Juarez pilot program, his waiver could be approved in a few days. Then he will return to the US, marry you, and continue the adjustment of status process. At that point he will be a legal permanent resident. He cannot become a citizen for at least three years after that (if I remember correctly).

Start by reading the K1 guide here on VJ. Also read the information on the Ciudad Juarez website about fiance visas and about the 601 waiver. Then read attorney Laurel Scott's memo on 601 waivers (www.visacentral.net) and all of the examples and information in the 601 waiver forum on www.immigrate2us.net. Also do a google search for the ciudad juarez pilot program or read here in the waiver forum so you understand how it works.
