As I am reading the topic here it gives me hope that I can be with my fiancee one day.

 

My question is I am the one who is divorce but not annulled here in the Philippines and me and my fiancee been figuring out how he can bring me to the states, can we apply a K1 visa for me so I can be with him in the states?

Or I still need to get an annulment before I can apply for a K1 Visa?or Fiancee Visa

What can I do? His been divorce for a long time already do we need to still present his divorce papers if we apply for K1 visa?

Hope somebody can give me an answer because it will help me a lot.

Answer:     Yes your fiance can file the I-129F if you are divorced in another country but not annulled or had the divorce recognized in the Philippines.     Divorce is recognized in the USA  ;)  :)  

 

You have to provide copies of your divorce decree for the I-129F process and during the embassy visa application later.

Does my fiancee needs to present his divorce papers too or he doesn't have too??

I am still using my ex-husbands last name because just like I say I am not annulled yet so all my documents is my ex last name so I am pretty sure I will have a problem on that or no?

All must submit copies of divorce decrees  .. if previously divorced.  

 

Nope won't have a problem with your last name still be that of your EX for the I-129F.

 

Issue you will have, eventually .. can't file ROM (Report of Marriage) so you can't renew your passport in your married name.

 

Question I have:   Both you and your EX are Filipino?

ROM is Philippines specific not US. So you wound be able to use your married name here in the USA

You can use your NEW married name in EVERYTHING in the USA, just not your Philippine passport, or anything Philippines related ... until you completed the Recognition of Divorce.   Excellent that your EX was a foreigner, you can complete Recognition of Divorce (someday) instead of completing the annulment process

 

Your fiance will need to include a copy of his divorce decree .. no matter how many years ago he was divorced.  And if divorced more than once, include copies of ALL divorce decrees.   Same applies to you.
