Went to the Texas DPS office to get a driver's license for my wife as we got our I-797 receipt for her I-485 submission a week ago.

 

I was under the impression that this was enough to get her license according to the REAL ID act. The "manager" there said that we needed her old (expired) driver's license and EAD card (or I797 receipt for submitted EAD).

 

Is this all correct or do I just have a misinformed DPS employee?

We had that same issue with TX DPS.  We were told that she need to wait until she received her EAD before they would issue a DL.  We got her GC before the EAD, so that solved the problem.

 

That was our experience, but I believe others were more successful. 

Finally done.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I think this is probably new for Texas...maybe all employees aren't aware.....the brochure that I was given when I first moved to Texas (and is still available online) doesn't list the I-797 as proof of lawful presence........  It is here: https://www.dps.texas.gov/internetforms/Forms/DL-57.pdf

Update:

 

I printed out the REAL ID form from the Texas DPS and took the morning off to go with my wife to ensure this happened. This time, the guy worked with us a bit but apparently her Alien number is not yet in their system so he had to submit it for "Stage 2" processing.

 

I guess we are supposed to receive a letter within a week or so.
