Has anyone received an RFE (apparently its pink...) for your AOS and along with the request for what they want, they ask you to write a statement and sign it in regards to I, such and such will be unable to work till 90 days after the RFE has been sent...or something to that effect? How weird? I thought that the EAD app would NOT get affected by any RFE's we receive for the AOS... The RFE seems it is only requesting my W-2 which I didn't send and asking for my dad's 1099 (which he does not file as he is not techinically self-employed) and if there was an extension which there wasn't...

I have yet to read it in entirety (my husband has it at home and I am at work). The main thing is WHY would they make him write he can't work when he is filing for an EAD which he has a BIO appt on Thursday? Anyone else receive something like this??

Here's what the letter says:

REQUEST FOR INITIAL EVIDENCE (I-485)

This office is unable to complete the processing of your Application to Register Permanent Residence or Adjust Status, (Form I-485) without initial information. Submit ALL the information requested below at one time. Failure to do so will result in denial. You must submit the information within 87 (eighty-seven) days to the following address: U.S. Department of Homeland Security, PO Box 648006, Lee's Summit, MO 64064. Include this letter with your response:

You are ineligible for interim employment authorisation pursuant to Title 8, Code of Federal Regulations, Section 103.2( B )(10)(ii) until ninety (90) days after the missing evidence is received.

All copies must be clear and legible. If you submit a document in any language other than English, it must be submitted with a full English translation. The translator must certify that the translation is complete and accurate, and that he or she is competent to translate. You must submit both the foreign language document and the English translation.

F. [x] (40) The sponsor or joint sponsor (if required) on Form I-864 Affidavit of Support must submit the following:

W-2s, 1099s, and/or all schedules submitted to the Internal Revenue Service (IRS) - a copy of his/her Federal income tax return was submitted and/or the sponsor or joint sponsor requested an extension to file his or her Federal income tax return

The main idea is if you get RFE, they stop processing your EAD for 90 days. But i never heard that you need to write some statement for them, like you are ok with this.

We also got a letter requesting W2,1099 (again). We sent it in (received 5-30-07) and a few days after receipt we were told that our process (I485) was resuming. Today we had our 485 interview letter in the mail.

Send them what they want and dont worry!

Prob just the W-2. That is what we are sending in. Very confusing..

Noooo, you'll get another RFE. It clearly states in the I-864 that ALL supporting documentation MUST be included. That includes W2's 1099's 1040's etc...so if you have interest income from a bank account, you have to send the paperwork for that...tuition statements....mortgage interest paid, EVERYTHING. Be careful here- anything in your tax return that references a supporting document- Make a photocopy of that supporting documentation and send it in!!!

Prob just the W-2. That is what we are sending in. Very confusing..

Noooo, you'll get another RFE. It clearly states in the I-864 that ALL supporting documentation MUST be included. That includes W2's 1099's 1040's etc...so if you have interest income from a bank account, you have to send the paperwork for that...tuition statements....mortgage interest paid, EVERYTHING. Be careful here- anything in your tax return that references a supporting document- Make a photocopy of that supporting documentation and send it in!!!

ok a 1099 is for those who are self-employed. If you do not have a 1099 you don't have to send one as it doesn't relate to you...I think the checked box request is a generic request paper. Obviously you can't send things that do not pertain to you and you do not have...

July 24: Received NOA (posted 7/21)

July 30: Received Bio Appt Letter in Mail

August 20 @ 2pm: Biometrics Appt. –

Sept 12: Approved!! Should be getting card within 60 days..

April 22: Mailing N400 Citizenship packet to Phoenix AZ! (about time!)

April 25 10:37am Phoenix USCIS Lockbox. Signed for by F DOMINGUEZ

April 28 NOA (received in mail May 2)

June 7 Biometrics Appt

July 26 8:10am Interview/Test APPROVED!

Jul 26 Oath Ceremony! Pete is now a US Citizen!
