Hi,
 

So my wife and I are ready to file for my Adjustment of Status and noticed they ask for proof of joint property etc. Thing is, everything is in her name as I was on a visa and not able to own anything in the US. She totalled her car and had to buy a new one just a month ago and it's in her name. So is the apartment we live in. I also have my foreign bank account I still use to withdraw cash from, so no joint anything. It's been incredibly hectic for us as we moved across the country to a state over 2 thousand miles away, totalled the car when we got here after a meeting with a deer, wife had to find new job, had to get a new apartment so we never even really thought about it. We did furnish the apartment we live in together, but that's about it. What should we do?

Two things that stand out. If you are living with her in the same apartment, you are required to be on the lease ( Most states this is a legal requirement), also if she has a car she should have auto insurance. Once again if you live with her even if you don't drive or have a license if you live at the same address you are required again at most companies, and in most states as a legal requirement to be on the insurance policy. You won't be covered, but you should be listed if you are at the same address. She can add you to any, if not all of the utilities at this said new apartment, water, gas, electric, cable, etc. and there are 3-4 more proofs of commingled finances. Why you both don't open a bank account ( Joint ) at some new bank is an easy 30 min. process. My wife and I have a joint account just for immigration purposes, and then we have our own separate accounts. I'm sure you will get other suggestions, but these are the big ones that stand out to me.

Thank you for responding, Loren. I was concerned with me not being a legal resident yet and how that would interfere with me being able to open bank accounts etc. I do not have a SSN and am out of status right now. We'll try adding me to the lease, we were just in a hurry to find an apartment and got it just in her name to speed it up as a lot of places have issues renting to people who are here on visas.

True, some apartment complexes are kinda difficult, but most will work with you on that. The only time it kinda becomes an issue is when they want to do background checks, and you don't have a SS number, but most will still add you pending getting your number. Banks are the same way, you might have to shop around, or search on here, but there are Banks that will let you open accounts or be added to your spouses account. It is some work on something's, but you can get it done. Credit unions are pretty flexible if you have any near your home. But look on here as I have seen many posts where people would mention banks that let them open accounts without a social.
