Question about Affidavit Of Support

Hey everyone,

 

I finally received my visa about 1 1/2 months ago, so off I flew. We had a huge ceremony with her friends and family, and this friday we will "officially" marry, just us, in a small courthouse.

 

I poured over the documents I need to fill out and send off after we marry, and I have a question. My fianceé already sent an I 864 for me as evidence to Frankfurt before my interview, as this was required. Now the AOS form tells me my fianceé has to send an I 864 again.

 

Do I really have to send a second I 864 for the AOS, or do they somehow have access to the first I 864 my fianceé already filled out? Thanks!

 

Oh, another question: The approval notice you have to attach as well, the I 797, has expired for a few months - is that important? It only shows that the initial process has been approved, anyway, but I figured I might as well ask.

Yes the AOS does require an I-864.  It probably hasn't changed much but it is required.

 

And attached a copy of the expired I-797
