If the agent told you to file a waiver, then I'd imagine that whatever his denial was for is covered under waiver applicability guidelines.

My Fiance just had his interview today and the consul officer told him he had to apply for a I-601 waiver. Do I have to write a hardship letter?

If the consul officer told him he had to apply for a 601 waiver, yes, you as the USC have to write a letter detailing and proving extreme hardship to you if his visa is ultimately denied. Check www.visacentral.net for waiver guidelines and advice and also www.immigrate2us.net in the waiver forum.

Just to reinforce what Kitkat said.

Yes you will have to prove extreme hardship which meant you have to write a hardship letter. You didnt say why he was denied. The circumstances behind the denial are very important as different rules apply to different causes of denial.

Strongly recommend you consult a lawyer and read the links supplied above.

We are still waiting, although we have finally confirmed that the motion is in London awaiting review. Until this last week we werent even sure that it was there and hadnt been passed directly to the Attorney generals office.

We are now down to waiting and hoping that this nightmare ends soon
