We're filling out the CoS for the green card for my wife (we were married June 1st), and I'm realizing that there's a bit of an interesting happening when it comes to her employment history.  See, she can't work in the U.S. until she gets her green card, but she's still working for her Albanian employer until she gets the green card.  At that point, she'll be switching to the American branch of her employer.  Thus, when it talks about her employment dates (From/To), should I list PRESENT in the "To:" heading, since she's still working with them?  Should I include some sort of explanation on the supplemental page that I'll be sending with?  What's the best official procedure for this one?

The whole remote work is a very dark grey area....

In your case might be even worse if she is transferring to the us branch of the company after getting EAD.

Nobody really can help you, read the uscis handbook on how they make decisions on cases and decide it on your own of it worth it or not.

 

Most of the employers understand the gap on your resume. At least I had no negative feedback after I told that I was doing immigration and thats the reason of the employment gap.
