Expiration of Approved Petition for Immigrant Visa Step Child Under 21

Hi Everyone,

 

Been searching online but cant find the answer. So here’s my question.

 

My sister has an NVC case number for her and her three kids. One kid who is 18 does not want to go with them yet, she said she will process her NVC Case before she is 21. Is that possible? or should she go with the mom since the petition was done with the mom?

You may want to clarify what type of visa.  We're pursuing K1/K2 visas and in that scenario the K2 visa eligibility expires one year after the K1 is issued.

My sister has IR1/CR1 visa, so the kids will be under IR2/CR2 visa.

CR2 does not have a follow to join option like a K2.  Maybe the CR2 could be delayed up to a year at the consulate but the beneficiary has to enter by age 21. 

 

They are already complete at the NVC because it can be delayed there too?

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well
