  1. Does he have to give consent for the child to leave the country?

 

1st:   Were the mother and father married?  (there would be documents from the courts from the annulment regarding custody.)  If yes, that requires the father's consent to bring the child to the States. 

 

2nd:  If the child is illegitimate, even with the father's surname, the mother has sole custody and you need nothing from the father.

 

As to the form .. You list the child in the I-129F is the appropriate section that you are completing for your fiancee.   Done.
