N-400 and taxes part 12 Q 6

Three questions:

 

1. We have had our share of tax issues over the years. We have had installment plan with IRS too. All is paid with Feds.

 

But right now we have two open years with the state, both of them are pending  appeal right now, but all is filed. (they reassessed my 2011, pretty much out of the blue, an I was late with 2015 and they re-assesed that too). And I am disagreeing about the amount in both cases.

 

So the N-400 application question on part 12 no 6 goes like this :

 

Do you owe any overdue Federal, state, or local taxes? Yes or No

Question on form: Have you EVER not filed a Federal, state, or local tax return since you became a lawful permanent
Yes/ No

 

So do I technically owe state taxes? Decision has not been made yet? I of course feel that I do not, but state thinks I do?

 

Question on form "Have you ever not filed? So they are all filed as of now, but we have not filed them timely, well quite often.

What is my answer?

 

2. If I am ever asked about this, for example during an interview. I really do not have answer without throwing my husband under the bus. My old me, relayed on my husband and trusted that he knows what is going on, and we always got in trouble, and I really did not have much clue, since where I am from, yearly taxes are not mandated from individuals. My new " me" years later stepped up to the plate , took it over, went through all the learning curves, and year by year chizzled them away. How do I answer that question which possibly will come up, without sounding like a whiny wife who talks bad about her husband. (We have been married for over 10 years, so sometimes you just gotta step up and stop waiting for miracle)

 

3. Can my citizenship be denied? How often does that happen. Would that affect my Green Card?

08/04/2006 - NOA1

08/28/2006 - NOA2 - approved

09/01/2006 - NVC - approved

09/07/2006 - Warsaw embassy sent packet 3 (damn post services, never received any)

09/18/2006 - packet 3 sent (Nothing fails)

09/27 - received packet 4

10/10 - medical exam

10/19 - INTERVIEW!

10/20 - received visa

11/7 - arrived in USA, POE YFK

1/19 - Married

02/23/2007 - Civil Surgeon (checked just vaccines for $ 25)

05/04/2007 - AOS package sent to Chicago

05/11/2007 - NOA1

05/15/2007 - NOA2 - ASC appointment letter about biometrics

05/24/2007 - RFE about tax forms w-2 and 1099!!!

06/05/2007 - Biometrics

21/06/2007 - NOA3 - Transfered to California

10/07/2007 - AOS approved, card production ordered!!!

19/07/2007 - Half year marriage anniversary - GC arrives!!!

07/08/2009 - Package sent (My cover letter 40 peaces of evidence)

07/14/2009 - check was cashed

07/10/2009 - NOA 1 received, GK extended for a year

07/17/2009 - received biometrics letter with my case number

08/06/2009 - scheduled biometrics appointment

11/16/2009 - approval

12/01/2009 - touched - card production ordered

2/26/2010 - got ten year card

No more departures!!!

No more typing!!!

I would answer this as Yes.  Technically, you *do* owe,  you're just disputing the amount that you owe them with your pending appeal.

This can be explained at the interview that you have a pending appeal with them, if/when asked.

Your answer would be No.  You've filed each year...filing late/on time is irrelevant for this question.

If you hadn't filed at all, yes it might have affected the Good Moral Character requirement.  However, you are caught up with all of your filing years, as you said.  Bring proof of your payment plan with IRS (if any), as well as any communication you've received regarding your later IRS filings still pending incase it is asked for by the IO.

Aug 17, 2017 (Day 33) - Interview Appointment Letter PDF posted online---GOT AN INTERVIEW DATE!!!

Aug 21, 2017 (Day 37) - Interview Appointment Letter received in the mail, appointment for 09/27/17
