if the immigrant is out of status and you haven't changed their name yet, SSA will not let you change the name until the immigrant has the Green Card.  My wife has a Sen in her maiden name, we tried to change it and we were told she's out of status and she will have to wait for her green card

I appreciate everyone’s advise. I think everyone has a different view I guess the only way to really know is go into the social security office but I would lean to say if she is out of status she will not be able to until EAD, green card or make a request at the interview

Just out curiosity, what letter exactly did you send to the NBC and how did you send it? If I’m able to change at green card interview if I sent a letter that would just be an extra precaution right?

 

I sent a letter requesting the name issue to be solved simply because I came to the US on a K-1 visa and back then far from all K-1 AOSers got an interview. Had I not gotten an interview then maybe my letter would've helped, who knows. I wanted to give it a try at least.

 

 

@Scandi how did you send a letter to NBC?  Can you provide additional details on this?  My wife and I are planning to change her last name during the AOS interview and any extra steps we can take to ensure we can do this at the interview would be helpful.
