N-400 Filing Questions

Hey Guys, 

I am about to submit my N-400 under 5 year of residence rule. I am concerned over a few questions I have to fill out correctly.

1. Did you ever fail to file federal taxes? In 2015 I was unemployed and did not know how exactly to file taxes (back when I lived with my husband and did not know all laws). I just paid federal tax for my husband for 2015, since it is past tax it is going to be processed a while. So, since I already paid for both of us, should I answer I DID NOT file a tax return?

2. I have been separated from my husband for almost 3 years, the past 3 years I filed as Married-filing Separate, will this may be an issue?

3. My husband and I barely speak and have no idea where exactly he resides (the most recent place was SoCal), I do not have any more information about him. In the box, they ask you the address your spouse lives what I should enter?

 

Please let me know ASAP. Thanks in advance.

1. Did your husband file a joint tax return? If so, you are covered. If not, since it seems like you didn’t file, you are in trouble.  Get a tax attorney. 

 

2.  Assuming you got your green card through marriage to a USA citizen or green card holder,  it will definitely be an issue. There will be questions.  Otherwise, no. 

 

3. Ask him for his address. If he does not reply or refuses to answer, write “unknown”. 

 

In general you will have problems convincing USCIS it was a bonafide marriage, if your green card was through marriage to a USA citizen or green card holder.

For 2015 in 2016 we did not file, BUT I did two weeks ago as married-filing jointly. I would say shortly, knowing I will have to provide taxes for the past 5 years, I made it up for 2015 just recently
