To anyone reading this going through the immigration process for a partner abroad, yes...you have to tell them to lay off the weed. Don't assume that's common sense, or that they stopped using it just because they didn't tell you they actively used it. 

 

We have a baby together who is an American citizen already, so this one year ban adds extra challenges for us...

Well yes, lay off any controlled substances (even if legal in the area of use). That would likely help one's case, but certainly doesn't prevent a 1 year ban. That decision is based on the totality of the circumstances as interpreted by the doctor during/after the evaluation. How long it was last used, how often it was used, etc. are all factors.

The idiocy of someone (knowing that there is a Federal prohibition on certain drug use) thinking they can just not worry about using is disturbing. Here are the consequences. I'm sorry that you and your USC child are having to suffer because of her poor choices.
