I am asking on behalf of a friend. She is under fiance visa and they got married before 90days( US citizen guy) last October 2017. Due to financial problem, they haven't apply for green card yet until today. Will my friend be subjected for deportation? Please help! Thanks

Since she already applied, the answer is no.

No Sir, she have not yet apply for her green card.

Yes - she is subject to deportation until she applies for Adjustment of Status.

Sorry for the confusion.😊 But do you think she can still apply anytime soon? Considering that they are already married here? But if not... gezzzz... it is gonna be a bad news for her.😞

Does it have a deadline to apply the AOS after they got married? Or does the count start from the time she arrived here in the US?

She can apply anytime and the overstay will be forgiven as long as she submits the paperwork.
