HI, 

my son (American Citizen) applied for me and my husband, we uploaded the very same financial documents provided by my son for Affidavit of support and tax return. It came out that for my husband they were accepted, for my application I received two messages:

1) your petitioner doesn't meet the minimum financial requirement and the consular officer will decide at the time of the interview, 

2) you must provide proof of employment of petitioner

I have two question: anybody knows why this difference between  two applications with the same sponsor?

Could the 1099 form, where the payers is indicated,  be enough as proof of employment or do I need a declaration from the  owner/partner of the law firm where my son work as an independent contractor?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That’s not a issue here. Same situation with us when our son petitioned both of us at the same time. Because each petition is adjudicated separately , and neither have been completed until after the others interview ..the petitioners declaration on each I864 is their household number plus one....

And have you been interviewed at the same time? What the Consular officer decided? I'm pretty nervous about that.

My sense is that the reviewing officer for one application interpreted the documents correctly, the other didn’t. Self employed use different documents to employed to meet the criteria. Perhaps reread the I864 instructions to ensure everything is full and correct as you think for the self employed .  Sounds like they are sending it to the Consulate for assessment at your interview.. unless your letter specifically requests further documents to be sent to the NVC. If no documents are requested by the NVC, head to  the interview and so expect the IO will get it right for both of you

Yes we have interviewed and issued visas and are in the US.  We had a similar note from the NVC on our I864 s but, like you, their comments about what we needed were not actually needed at all by the IO

The interview was no issue .. ours were scheduled for the same time same day and we were interviewed at the window together .. maybe 2 questions .. who is petitioning you ? Where does the petitioner live ?  It’s actually very underwhelming after all the wait !! I remember standing there thinking “ huh.. that’s it ??? “

hope so, they ask for proof of employment of my son (who actually is self-employed), the I864 has been filled in the same way for me and my husband. The matter is the minimum financial requirement, enough for my husband, not sufficient for me (?!!)
