Humanitarian reinstatement case now in NVC. Who is the petitioner?

Hi.  Question.  A Humanitarian Reinstatement case has now been approved and will soon be sent to NVC.   Just wanting to know... even though the petitioner is deceased, but when filling out the visa application online, I guess the petitioner information remains the same, right?  Just fill it out like normal, right?

Hi i have a question, after you notified NVC of the death of your petitioner, how many months have you waited until you got a notice from USCIS that they got your files from NVC? In my case, my priority date was already current last August 2019 and  I asked assistance from a lawyer to help me file a Humanitarian case, we informed NVC Aug 29 that the petitioner died and we will apply for HR, NVC acknowledged by Sept 25 and replied to us that document is in processing. However, until now after two months we are still not notified by USCIS that they received a file from NVC, and when we checked case status in website, still not showing any confirmation that they received the files. My atty. said it is usually only 4 weeks. She also don't want to forward my papers and docs request for HR if she is not sure that my files were received by USCIS as it may be misplaced. We tried calling USCIS but they said what info they have is same with what is in the website case status. Thank you and looking forward to hear from you.

Hello, I want to ask the status of your case. Im CR1 beneficiary too and my petitioner passed away. I sent already the death cert of my husband to NVC, was your case sent back to uscis?

Poster hasn't been online since December 1, 2019 and, like you,  hasn't provided any sort of a timeline or country in their profile.

March 2, 2018  Married In Hong Kong

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Hi, last Dec 26 my lawyer received a notice from USCIS that NVC returned my files to them and it's on the process now but no timeline. I guess it will be more delays to come due to the current situation.

Omg. Does your I-130 was approved before your petitioner passed away?. Mine I got case number already. I am so worried if they will return back my case to uscis. It will be again a long process.

when your case was in uscis for Reinstatement, what does your lawyer did?

Yes, it was approved June 1998 under F1 category but I got married and was reclassified to F3 but my petitioner died 2014. So unfortunate, but still hoping for a positive response. My lawyer said usually the outcome is 10 months after application of HR request.

aha okay. we have different visa category type. Mine is CR1 so I hope they will not return back my case to uscis instead converting only to widow visa.
