New Affidavit of Support?

Hey,

 

I was just wondering if my Mother in law needed to fill out a new affidavit of support? She filled one out in September 2017 when I first applied for AOS. Now that I finally have my interview in April, she has a different job. Am I ok just bringing the pay stubs and letter from her new employer or does she need to fill out an entirely new I-864?

You will need to fill out a new one as she will need to declare the income she reported on her last three tax returns which will be 2018, 2017, 2016 if you apply after April 15th, 2019. Also it needs to be dated currently.

Just to add, you should fill out a new I-864, but don't have to volunteer it unless IO asks. They may not, but if they ask anything like, "have there been any changes to the sponsor's employment" - give them the new form with updated evidence.

2015-11-23: Last TN received at CBP

2017-06-12: Married

2018-06-25: Mailed I-485, I-864, I-130/I-130A, and I-765 to USCIS

2018-07-24: Biometrics appointment

2018-08-28: Expedite request submitted for EAD via USCIS support line

2018-09-21: EAD and SSN received in the mail

2018-10-11: Case is ready to be scheduled for interview

2018-10-31: Interview is scheduled

2018-11-21: TN expired

2018-12-11: AOS Interview - approved 

2018-12-18: Green Card received

------------------

2020-12-11: Conditional green card expires
