Question For A Friend

Hello All:
I hope this finds you well. I am asking questions for a friend. One of my friends is engaged to a Libyan. Her fiancee is currently in Libya, and he is college educated and working however she knows she can't file for him without difficulty due to the ban that was put on him on the country in 2017 by the current administration. However, he is up for immigration in Canada which is still in process. The issue is that my friend has an aging mother and a teenager in high school. The teenager has 3 years left after this school year. She is trying to weigh her options which would be benifical for her. She is American, born and raised, but if her fiancee is a permanent resident of Canada would it be possible for her to petition him for a greencard once he is settled there in Canada or would it be easier for her to be sponsored by fiancee and move to Canada once settled?

Any advice would be helpful for her.

Thanks!

What is the timeline for moving to Canada, if they married before the move could she go as his spouse?

She said if everything goes well, he should be Canada in Canada by the end of the year. He is in his process for immigration to Canada. She thinks anything such as a marriage might mess things up before he is settled in Canada. I'm not that versed in immigration for the US so I told her she should just have him apply for her to go to Canada. However, she doesn't want to leave her aging mother and son and I totally understand that. She is just trying to see which one is the better option.

Very much depends on her priorities, sounds she does not know the answer to the Canada side so should investiater her options.  Maybe the child could go as well.

Just FYI, any travel ban issues will not be different if he is petitioned as an immigrant in Canada, vs at home in Libya.

Maybe by that time however, the travel ban will be a thing of the past.
